TINJAUAN HUKUM ISLAM TERHADAP PEMBATALAN TRANSAKSI PESANAN PEMBUATAN KAIN TENUN DI KABUPATEN BENGKALIS

In general, cancellation of the agreement is impossible, because the basis of the agreement is the agreement of both parties bound by the agreement. Regarding what has been agreed, each party must respect each other for what has been agreed because in the provisions of the law. The concept in the transaction of woven fabric craftsmen is usually in the form of orders and reservations, consumers place orders with woven fabric craftsmen where payment is made after the order is made or payment at the end of the transaction. In Islam, this kind of agreement is called the istishna agreement where in this agreement someone who wants a product in this case is a product that is structural or an object that requires a process and is not available in the form on the market so that when the product is desired, the consumer will place an order with the producer with the provisions that apply in accordance with Islamic principles. Sociological/empirical legal research method with primary data comes from the community as informants and secondary data comes from written data. The data collection techniques used are interviews, documentation, and observations conducted in Bengkalis Regency. The subjects in this study were Woven Fabric craftsmen. while the object of the research is the Cancellation of Woven Fabric Making Transactions in Bengkalis Regency. Data can be analyzed qualitatively which produces descriptive data. The results of the study, namely the cancellation of the transaction for making woven cloth in Sebauk Village, there was a problem in the form of a transaction for ordering woven cloth, the problem was found to be an obstacle in the transaction of woven cloth at the weaving craftsmen in Bengkalis Regency. Based on the results of the research that has been done, it is known that the unilateral cancellation of the agreement is in line with Islamic law based on Fatwa NO: 06 / DSNMUI / IV / 2000.
