Abstract

Land right certificates are valid as accurate evidence as stated in article 19 paragraph (2) letter C of the UUPA and article 32 paragraph (1) PP No. 24 of 1997 concerning land registration. Land certificates were originally issued in analog form, but now the government has issued a new rule regarding proof of ownership of land namely Minister of ATR/BPN Regulation No. 1 of 2021 about electronic certificate. The presence of this electronic certificate is expected to be a solution to the problem of land disputes because everything has been systemized electronically. The purpose of this study is to provide knowledge and understanding of the position of electronic land certificates in land registration law in Indonesia. The problem approach method used is normative juridical using primary and secondary legal sources. The method of collecting legal materials uses a literature study. The results of this study are the guarantee of ownership of land rights with electronic certificates in the form of electronic document. Electronic certificates provide benefits to the community in the form of easy access to digital data and free from counterfeiting of land certificates which is a guarantee of legal certainty.
